The legal guarantee of conformity and a manufacturer guarantee are two different things - with two different labels. Here is which applies when, what the GARAN label means, and how to use both correctly.
What is the difference between the legal guarantee and a manufacturer guarantee?
The legal guarantee of conformity is mandatory, applies by law to every seller and all goods (at least 2 years) - this is what the official notice (Annex I) communicates. A manufacturer guarantee is voluntary: it is offered by the producer, free of charge, covers the entire good and lasts more than 2 years - this is what the GARAN label (Annex II) stands for.
Legal guarantee of conformity
Mandatory, by law, every seller, all goods, at least 2 years (Directive (EU) 2019/771, in Germany §§ 434 ff. BGB). Uses the official notice (Annex I).
Manufacturer guarantee (durability)
Voluntary, by the producer, free of charge, entire good, more than 2 years. Uses the GARAN label (Annex II).
The legal guarantee of conformity applies always and to every seller selling goods to consumers - at least two years. For used goods a shorter period may apply, but not less than one year.
This is communicated by the harmonised notice (Annex I of Regulation (EU) 2025/1960). It must be shown as a shop-level, prominent reminder and must not be altered - neither text, nor colours, nor the QR code.
The GARAN label stands for a commercial guarantee of durabilitythat may only be used when the producer offers it voluntarily - free of charge, for the entire good (not just a component) and with a duration of more than two years.
Important: sellers should not actively seek the guarantee information from the producer (e.g. on producer websites). The producer makes it available.
Always: the legal-guarantee notice
Mandatory for all goods sales to consumers - the app shows it automatically in the customer's language.
Only for a real producer guarantee: GARAN
Only when the producer offers a free durability guarantee over 2 years covering the entire good.
Never for other guarantees
The GARAN label must not be used for other commercial guarantees.
No all-covered impression
In banners with multiple products, do not place it so that all products appear covered.
What is the difference between a legal guarantee and a manufacturer guarantee?
The legal guarantee of conformity is required by law (at least 2 years, every seller, all goods). A manufacturer guarantee is voluntary and comes from the producer. The legal guarantee is communicated by the official notice (Annex I); a manufacturer durability guarantee uses the GARAN label (Annex II).
Do I need the GARAN label?
Only if the producer offers a free durability guarantee of more than two years covering the entire product. The official legal-guarantee notice, by contrast, is always required.
When may I use the GARAN label?
Only for a genuine producer durability guarantee: offered by the producer, free of charge, covering the entire good (not just a component) and lasting more than two years. It is not allowed for other commercial guarantees.
Do I have to search the producer for guarantee information?
No. The official EU guidelines state that sellers should not actively seek such information from the producer. The producer makes the guarantee information available; you display the GARAN label where such a guarantee exists.
Can I redesign the GARAN label or change the years?
Only the duration in years, brand and model identifier are editable. Fixed elements such as the title, shield logo, QR code and the language line must not be changed. The app renders it according to the rules.
